Bearly Defense sells several genuinely different kinds of product, and they are not interchangeable in law — each category carries its own shipping outcome. The table below lists each category, what the items in it are, and where each one ships.

Simple Spike and The Black Talon are specifically designed to comply with the laws of all 50 states. They are the only items in the Bearly Defense line — the pointed and knuckle-style hardware, as distinct from the Bearly Afloat and Bearly Nature goods that no weapons statute touches in the first place — that we ship to every one of the 51 destinations with nothing blocked anywhere. They were engineered to the statutes, and clearing every destination takes two separate arguments, not one.

  • Geometry. A working point on a tool body, no multi-finger bar, no palm brace, and no knife profile. On our reading that puts them outside the per-se knuckles bans, which are written around a device worn across several fingers to reinforce a punch, and outside the statutes that classify on a knife or dagger profile.
  • Purpose. Several states do not ban a pointed object outright. They ban an item that was manufactured, designed, or adapted to be used as a weapon, or one that serves no common lawful purpose. A genuine utility tool with real cordage and field uses does not meet those elements — which is why these items are built, described and sold as tools and nothing else.

Both arguments have to hold. Neither one carries every state on its own, and in the states that turn on purpose the tool description is not decoration — it is the whole basis on which we ship there.

Sale being unrestricted everywhere is not the same as carry being unrestricted everywhere, and the purpose argument above does not travel to the carry question. Several states apply broad “dangerous implement” language to any pointed object, and some concealed-carry statutes classify on physical capability alone with no weapon-purpose element at all — so these tools may still require the carry-caution acknowledgement in your state. Bearly Afloat & Bearly Nature goods

Not everything we make is regulated hardware. BearlyAfloat Key Chain, WaterPORT Accessory Mount are ordinary consumer goods moulded in UV-stable ASA plastic. They have no point, no edge, no finger holes and no striking surface, and no weapons statute in any of the 51 destinations reaches them. They ship to all 50 states + DC, they never carry a carry-caution acknowledgement, and nothing on this page about knuckles, points or knife profiles applies to them. If one of these is the only thing in your cart, the state restrictions below do not affect your order.

How We Decide Where Each Product Ships

Every item in the catalogue was assessed against the weapons statutes of all 51 U.S. destinations — the 50 states and the District of Columbia — one product and one statute at a time. Each product/destination pair lands in one of three places:

  • Available. Nothing in that state's law reaches the item as we understand it, and we ship it there normally.
  • Available with a carry-caution acknowledgement. Sale is not barred, but that state has broad “dangerous weapon,” “offensive weapon,” or concealed-carry language that could reach the item depending on context. You must tick the acknowledgement on the product page before the item can be added to your cart.
  • Not sold. The statute reaches the item, or is broad or unsettled enough that we are not willing to put a customer on the wrong side of it. We do not ship it there at all.

What the statutes actually key on

Weapons statutes do not all ask the same question, which is why one product can be unavailable in a state that another sails through. Broadly, they fall into three kinds, and each one is defeated — or not — by something different about the item:

  • Form. The statute describes a shape: finger holes joined by a bar across the knuckles, a dirk or dagger profile, a club with a heavier end. An item either has that geometry or it does not, and no description changes the answer.
  • Purpose. The statute reaches an item only where it was manufactured, designed, or adapted to be used as a weapon, or where it serves no common lawful purpose. Here what the object genuinely is, and what it is genuinely made and sold for, decides the outcome — which is why our utility tools are built, described, and sold as tools and nothing else.
  • Capability. The statute asks only what the object could do — whether it is capable of ready use as a stabbing instrument, or could serve the same purpose with the same effect as a prohibited item. Purpose and labelling are irrelevant to this kind; only the physical thing counts. Capability language is common in concealed-carry provisions, which is why sale and carry are separate questions throughout this page.

We read close calls conservatively — where a statute is ambiguous or a state has no case law on a device of that type, we block rather than ship. That means some items are withheld from states where they may well be perfectly lawful. We would rather be over-careful with your record than with our order volume.

Availability is enforced twice: the product page hides or gates the item based on your state, and the shipping address is checked again when the order is placed. Our reading is also revisable — where later research changes how a statute reaches one of our products, the state pages and checkout are updated to match, and that current position governs.

Materials & What the Products Physically Are

Every item in the Bearly Defense line — every category above except the Bearly Afloat and Bearly Nature goods, which are a separate brand in a separate material — is made from the same stuff: PET-CF, carbon-fiber-reinforced polyethylene terephthalate. It is an ultra-light-weight composite that is 100% non-metallic, high temperature resistant, impact resistant, and weather resistant, with an exceptional strength-to-weight ratio. Every one is made in Texas, USA.

  • The tips are pointed. They are genuine points, not blunted nubs. They ship with a defined point and can be re-pointed at home with a file. Because the tip is polymer rather than steel, it can break — treat it as a working point on a plastic tool, not as a steel spike.
  • The edges are not sharp. The material is a plastic composite, so the edges are dull and cannot cut the way a knife edge cuts. Nothing we sell ships with a sharpened edge.
  • The correct description of every pointed item we make is: a pointed tip with dull, non-cutting edges. If you see any other formulation anywhere on this site, this one governs.
  • Bearly Afloat and Bearly Nature goods are moulded from UV-stable ASA plastic instead, and have neither a point nor an edge.

Quality guarantee

We guarantee our carbon fiber tools will be free of manufacturing defects which affect the function of the item, or they will be replaced. The guarantee runs 1 year from purchase by an authorized reseller and 90 days from the date of purchase by the final consumer. It does not cover damage, wear and tear, normal use, or anything other than an original manufacturing defect. The consumer guarantee applies only where the item was purchased by the consumer during the reseller guarantee period.

Not every product is available for sale or shipment to every U.S. state. The blocked list is different for every product, because the statutes are different: a four-finger knuckle duster is caught by a per-se knuckles ban that never touches a pointed tool, and a knife-profile item is caught by dirk/dagger language that never touches a keychain. There is no single store-wide list.

General policy

  • If your shipping address is in a blocked state for an item in your cart, that order will be cancelled and a full refund issued.
  • Even in states where we ship, your local laws (county, city, municipality) may impose additional restrictions that we do not track.
  • Blocked-state and carry-caution lists are maintained to the best of our knowledge and updated as laws change and as our research is revised.
  • Where our reading of a statute has changed, the state pages and the availability shown at checkout are always the current, authoritative position.

Carry-Caution States

A number of states have laws that broadly define “dangerous weapons,” “offensive weapons,” or “deadly weapons” beyond their specific prohibited-item lists, or that restrict concealed carry of almost anything. Even where an item falls outside every named statutory category in that state, a cautious interpretation or context-dependent enforcement may treat it as a dangerous implement in certain situations.

Purchase legality and carry legality are two different questions. We only sell and ship items to places where they are legally allowed to be sold. Whether you may then carry that item, where, and how, is governed by different law and is your responsibility.

Where a product is flagged carry-caution for your state, you must acknowledge on the product page, before the item can be added to your cart, that carry may be restricted where you live, that you have read this page, and that you accept full personal responsibility for verifying legality and for lawful use in your jurisdiction. That acknowledgement is recorded with the order. It is not optional.

Our products are offered exclusively for lawful use. They must never be used to threaten or inflict injury unlawfully. Misuse or aggressive deployment may violate criminal statutes irrespective of an item's lawful construction or lawful sale. Neither the manufacturer, distributor, nor retailer shall be liable for any direct or consequential damages arising from misuse, negligent operation, or possession of any product in prohibited locations. The purchaser acknowledges and accepts these terms upon acquisition.

That is the whole of our guidance, and it reflects a simple philosophy: responsibility, preparation, and composure are stronger than aggression. Knowing what you are carrying, and knowing what the law where you stand says about it, is the first part of carrying it well.

Consumer Notice

NOTICE: State and local laws vary. Even where an item is lawfully sold to you, possession or carry may be restricted in certain jurisdictions and locations — such as schools, government buildings, courts, airports, or transportation hubs. Purchasers are responsible for knowing and complying with all applicable laws before purchase or shipment.

INTENDED USE: Lawful use only. The utility multi-tools are sold for utility, outdoor, and rescue work. The knuckle dusters, the knuckle-class pieces, and the pointed and knife-profile items are sold for lawful personal defense and everyday carry in the states where they are legal. Not a toy. Nothing sold here is a toy or intended for anyone under 18.
